Openness and transparency are becoming hallmarks of responsible data practice in science and governance. Concerns about data falsification, erroneous analysis, and misleading presentation of research results have recently strengthened the call for new procedures that ensure public accountability for data-driven decisions. Though we generally count ourselves in favor of increased transparency in data practice, this Commentary highlights a caveat. We suggest that legislative efforts that invoke the language of data transparency can sometimes function as “Trojan Horses” through which other political (...) goals are pursued. Framing these maneuvers in the language of transparency can be strategic, because approaches that emphasize open access to data carry tremendous appeal, particularly in current political and technological contexts. We illustrate our argument through two examples of pro-transparency policy efforts, one historical and one current: industry-backed “sound science” initiatives in the 1990s, and contemporary legislative efforts to open environmental data to public inspection. Rules that exist mainly to impede science-based policy processes weaponize the concept of data transparency. The discussion illustrates that, much as Big Data itself requires critical assessment, the processes and principles that attend it—like transparency—also carry political valence, and, as such, warrant careful analysis. We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. Morality, Rules, and Consequences: A Critical Reader explores for students and researchers the relationship between consequentialist theory and moral rules. Most of the chapters focus on rule consequentialism or on the distinction between act and rule versions of consequentialism. Rare copy number variants have a prominent role in the aetiology of schizophrenia and other neuropsychiatric disorders. Substantial risk for schizophrenia is conferred by large CNVs at several loci, including microdeletions at 1q21.1, 3q29, 15q13.3 and 22q11.2 and microduplication at 16p11.2. However, these CNVs collectively account for a small fraction of cases, and the relevant genes and neurobiological mechanisms are not well understood. Here we performed a large two-stage genome-wide scan of rare CNVs and report the significant association of copy (...) number gains at chromosome 7q36.3 with schizophrenia. Microduplications with variable breakpoints occurred within a 362-kilobase region and were detected in 29 of 8,290 patients versus 2 of 7,431 controls in the combined sample. All duplications overlapped or were located within 89 kilobases upstream of the vasoactive intestinal peptide receptor gene VIPR2. VIPR2 transcription and cyclic-AMP signalling were significantly increased in cultured lymphocytes from patients with microduplications of 7q36.3. These findings implicate altered vasoactive intestinal peptide signalling in the pathogenesis of schizophrenia and indicate the VPAC2 receptor as a potential target for the development of new antipsychotic drugs. © 2011 Macmillan Publishers Limited. Consequently, parts of Hume's own work are stripped of meaning, isolated as they are from later (...) developments. The puzzles about Smith's analysis which I find illuminated by Hume's are the following: 1. Why does Smith both defend the importance of economic growth for the material of well-being of the working class and claim that property originates as spoil, impoverishing the working class? After all, in the classical system the existence of property is one requisite for economic growth. 2. Why does Smith exalt the assumption of self-interested behavior in private activity but claim that irrationality dominates the political process? 3. Why does Smith deny the importance of benevolence in Wealth of Nations and insist on the importance of morality Sentiment morality in Theory of Moral its?3 The three questions have a common feature: they are related to the question of how public goods are provided. The particular public good in question is the institution of private property. As with all true I am obligated to the Center for Study of Public Choice for generous support of my research. Ill public goods, society considered as a whole benefits from having such an institution, but each individual considered separately can gain by anti-social behavior.4 Public goods provide a considerable difficulty for any social institution; neither competition in the market nor government requests that individuals reveal how much they wish to be taxed are certain to be efficient. There are aspects of the classical economic analysis which stress the importance of moral information as a partial solution to the public goods problem. By "moral information" I only require that the theory is employed as a guide and that if an individual acts contrary to the theory, this choice is not cited as "falsifying" the theory. Rather, something is said to be "wrong" or "wicked" about the choice.6 Much of modern economic analysis assumes that individuals have perfect information; this postulate rules out any significant role for moral information in the provision of the public goods. To avoid assuming away such a role for morality, we will drop the perfect information assumption and then examine if we can make sense of the classics' attack on the public goods problem. Of course, the specification that individuals see their own interests very poorly is consistent with Smith's general approach. The technique employed below is to look at the issue which Hume and Smith addressed as a problem in modern economics. The key difficulty is to determine under what conditions moral information could guide individuals with very imperfect perceptions to maximize their utility. In particular, suppose we find that moral guidance tells an individual how efficiently to produce. Is this morality self-enforcing or are resources required to persuade people to act in accord with these teachings? If resources are required, we will not pay much attention to just how this persuasion 112 is provided, e.g., whether we tell people that theft is "evil" or whether we hang a few thieves. General production theory tells us we probably will do both, but this is a separate issue. The argument to be advanced is that moral information has self-enforcement properties in private activities but these properties are missing in public activities. In this account, then, real resources will be required for implementing the morality. This consideration in turn raises an interesting issue. If the government expends these resources, what reason is there to believe that they will be provided to serve the public interest and not the interest of the government? I shall argue rst that Wittgenstein’s philosophy—speci cally in his ideas concerning ethics—can help resolve a challenge such as he imagined his brother Paul faced. My argument faces an immediate di culty. Though Wittgenstein was famously deeply concerned with ethical or moral matters, he also maintained that the will was powerless to e ect change in the world, because will and world were wholly independent. But if the will is powerless, then what is left for the expression of someone’s ethical (...) engagement with the world? It is as if, by this claim, Wittgenstein erased ethics, contrary to what we know of his interests and contrary to what I am arguing. Therefore I shall argue second that we can honor Wittgenstein’s serious interest in ethics by distilling and elaborating from his conception of the will as powerless an account of morality that is not dependent on the power to act, i.e., on agency, but which still gives a place for engaging one’s moral challenges. This account is, I suggest, a plausible reconstruction of Wittgenstein’s view of ethics as it is sparingly set out in his writings. The account I attribute to Wittgenstein is of additional philosophical interest for its revisionary implications for contemporary moral theories. An Morality without agency 263 emphasis on instrumental action as the exemplar of moral response can dis- tort moral philosophy. Moral philosophy, I shall claim, does not wait on theories of action or on what they presuppose, namely agency. To support this claim, I propose—following the reconstruction of Wittgenstein’s account of morality without agency—to suppose that we lack the power to act. Then we can see how little changes in the possibilities for moral understanding and response. If an intelligible account of morality can be recovered without action or agency, then there is a prima facie reason to doubt that action or agency is central to morality. I shall proceed in four sections. First, I shall set out Wittgenstein’s view of ethics based on his three central themes. Second, I shall reconstruct his view in a way that makes it more plausible and reduces its dependence on pecu- liarities of his philosophy. Third, I shall use Wittgenstein’s reconstructed ethical views to engage contemporary views. Finally, I will return to the challenge that Wittgenstein’s brother faced. (shrink)

I provide an explanation of moral understanding. I begin by describing decisions, es- pecially moral ones. I detail ways in which deviations from an ideal of decision-making occur. I link deviations to characteristic critical judgments, e.g. being cavalier, banal, coura- geous, etc. Moral judgments are among these and carry a particular personal gravity. The question I entertain in following chapters is: how do they carry this gravity? In answering the question, I try “external” accounts of moral understanding. I distin- guish (...) between the ideas of a person and a life. The idea of a life essayed is of a network of relations to others. The character of those relations, e.g. friendship, is the object of our understanding of ourselves and our lives. I argue that one’s understanding of oneself conditions the context of decision-making. I elaborate one way of making moral under- standing answerable to truth using Plato’s metaphysics in the Philebus. Truth is valued and truth is essential to the independence of the moral such that seeming right and being right are distinct. However, truth is neither primary nor exhaustive of morality, because we have additional distinct resources for morally judging others. I turn instead to an “internal” account of moral understanding to answer the question regarding the personal gravity of moral criticism. Using Winch’s work on universalizabil- ity and fellowship, I argue that our conception of others must be sufficient to reflect their individuality within our moral understanding. Second, using Gaita’s work on remorse and the lucidity of self-reflection, I argue that the truth about ourselves and the wrong we do others can arrest and constrain our moral understanding and our authority. Moral understanding operates in a social milieu: argument, conversation and rational- ity. Arguments are grounded in meanings with primary (shared) sense, but solicit agree- ment in secondary sense—of what is similar, of what follows. Meaning in the secondary sense can be necessarily practical, creating practical necessities within points of view. Accounting for the consequences and understanding of disagreement is identified as pressing. An original contribution is the idea of critical authority. One’s articulation of moral meaning is controlled via the critical authority expressed using critical vocabulary. Accepting another’s critical authority is based, in differing domains, on our relation to them, e.g. friendship, trust, fellowship. The nature of inter-personal relations are delim- ited by the critical authority characteristic of those relations. Critical authority explains the independent and personal force of moral criticism. To be intelligible depends on accepting some critical authorities, though I allow for the intelligible repudiation of morality in some circumstances. Wronging someone is ex- plained as denying his critical authority, thus denying his relation to oneself, and thereby undermining his place in the moral world. The consequence of wrongdoing is the disinte- gration of the moral world. I defend against Nagel’s realism and Korsgaard’s constructivism. Both are committed to judging individuals but their accounts of morality undermine the intelligibility of the personal gravity of moral criticism. Developing the idea of Moral Consensus, I defend myself against the related charge of relativism. (shrink)

ICAP is a theory of active learning that differentiates students’ engagement based on their behaviors. ICAP postulates that Interactive engagement, demonstrated by co‐generative collaborative behaviors, is superior for learning to Constructive engagement, indicated by generative behaviors. Both kinds of engagement exceed the benefits of Active or Passive engagement, marked by manipulative and attentive behaviors, respectively. This paper discusses a 5‐year project that attempted to translate ICAP into a theory of instruction using five successive measures: (a) teachers’ understanding of ICAP after (...) completing an online module, (b) their success at designing lesson plans using different ICAP modes, (c) fidelity of teachers’ classroom implementation, (d) modes of students’ enacted behaviors, and (e) students’ learning outcomes. Although teachers had minimal success in designing Constructive and Interactive activities, students nevertheless learned significantly more in the context of Constructive than Active activities. In its most generally accepted sense, the linguistic turn in philosophy consists in ascribing to linguistic processes certain phenomena and specifiable modes of relating objects attributed, in a previous instance, either to factual processes or lines of thought. This approach is not limited to the two figures you invoke in your question. The linguistic turn also has two stages of development that, from my experience, have been more noticeable in France than in the United States. The first phase, then, emerged with Lévi-Strauss and his structural approach to social relations founded on a linguistic model of relationality, subsequently reprised in Lacan's psychoanalytic notion that "the unconscious is structured like a language" that, in its turn, conjoins the energetic mental processes Freud discusses to linguistic practices. The primacy of "the linguistic" thus granted language all the properties of the Freudian unconscious [End Page 113] along with those of a Marxist notion of infrastructure. The Saussurian opposition between langue and parole provided a privileged status to a linguistic model whose role was that of a general law that unconsciously structures the behavior of individuals and societies. It is on the basis of these parameters that the structuralist moment of the linguistic turn was constituted. At one and the same time, the analysis of speech acts became first and foremost a "symptomatic" analysis of those procedures of misrecognition that linguistically structured both the behavior of individuals and social relations. When we "read" Le Capital with Althusser, the interpretive and methodological schema for linguistic phenomena operated like a kind of "policing of the enunciated": that is, a search for those unsuccessful (i.e., inadequate) modes of expression that exemplify such symptomatic procedures of misrecognition.The second phase of the linguistic turn constituted itself more ambiguously. By showing how the Nazis viewed the camp inmates as completely disconnected from their own lives, Levi bears witness to the Nazis' restricted willingness to grant humanity, to their denial of the internal relation which ties them to the inmates. Since the book offers insights for those who ask themselves "what is it to be human?" (and what remains of the human in extreme situations?), its main philosophical issue is whether or not something admits being seen as human.4Wittgenstein describes the attitudes we adopt in reacting to other creatures by analyzing the grammar of "seeing something as something:" only of a living human being, he famously adds, can we say: he [End Page 444] or she has a soul (see also PI, § 281).5 That the human body stands as one of the criteria for the ascription of psychological predicates—that human beings are endowed with an expressive power that neither statues nor animals possess; that human beings around us exert by their very presence a power which belongs uniquely to them—is suggested by the fact that even when we fantasize about living chairs or tables, for example in cartoons, we tend to lend human features to such animated furniture. So, according to Wittgenstein there is a conceptual connection between psychological predicates and certain kinds of human expression. But, one must add, this connection is achieved only through use, and is given only within the context of a form of life. The context of a shared form of life is needed because without it those forms of expressive behavior would not be intelligible: only if I am prepared to regard the object before me as a human being will I smile back and even talk to it. A living body is hence not enough: what is needed is a role through which such expressions are performed and have a point.In a similar vein, Levi shows the extent to which our experience of something as human depends on our relation to it—on the quality of our stance towards it. The law views with suspicion statistical evidence, even evidence that is probabilistically on a par with direct, individual evidence that the law is in no way suspicious of. But it has proved remarkably hard to either justify this suspicion, or to debunk it. In this paper, we connect the discussion of statistical evidence to broader epistemological discussions of similar phenomena. We highlight Sensitivity – the requirement that a belief be counterfactually sensitive to the truth in a specific way – as (...) a way of epistemically explaining the legal suspicion towards statistical evidence. Still, we do not think of this as a satisfactory vindication of the reluctance to rely on statistical evidence. Knowledge – and Sensitivity, and indeed epistemology in general – are of little, if any, legal value. Instead, we tell an incentive-based story vindicating the suspicion towards statistical evidence. We conclude by showing that the epistemological story and the incentive-based story are closely and interestingly related, and by offering initial thoughts about the role of statistical evidence in morality. People are often offended by beliefs, expect apologies for beliefs, apologize for their own beliefs. In many mundane cases, people are morally criticized for their beliefs. Intuitively, then, beliefs seem to sometimes wrong people. Recently, the philosophical literature has picked up on this theme, and has started to discuss it under the heading of doxastic wrongdoing. In this paper we argue that despite the strength of such initial intuitions, at the end of the day they have to be rejected. We distinguish between modest and ambitious doxastic wrongdoing theories (the former deny, while the latter accept, the possibility of a morally wrong yet epistemically permissible belief); we argue that each of these options faces insurmountable problems; and we offer partly debunking explanations of the intuitions purportedly supporting doxastic wrongdoing. Statistical evidence—say, that 95% of your co-workers badmouth each other—can never render resenting your colleague appropriate, in the way that other evidence (say, the testimony of a reliable friend) can. The problem of statistical resentment is to explain why. We put the problem of statistical resentment in several wider contexts: The context of the problem of statistical evidence in legal theory; the epistemological context—with problems like the lottery paradox for knowledge, epistemic impurism and doxastic wrongdoing; and the context of a (...) wider set of examples of responses and attitudes that seem not to be appropriately groundable in statistical evidence. Regrettably, we do not come up with a fully general, fully adequate, fully unified account of all the phenomena discussed. But we give reasons to believe that no such account is forthcoming, and we sketch a somewhat messier account that may be the best that can be had here. (shrink)

ABSTRACTIn a recent paper, Michael Pardo argues that the epistemic property that is legally relevant is the one called Safety, rather than Sensitivity. In the process, he argues against our Sensitivity-related account of statistical evidence. Here we revisit these issues, partly in order to respond to Pardo, and partly in order to make general claims about legal epistemology. We clarify our account, we show how it adequately deals with counterexamples and other worries, we raise suspicions about Safety's value here, and (...) we revisit our general skepticism about the role that epistemological considerations should play in determining legal policy. Plant protection problems are simulated by a system of ordinary differential equations with given initial conditions. The sensitivity and resistance of pathogen subpopulations to fungicide mixtures, fungicide weathering, plant growth, etc. are taken into consideration. The system of equations is solved numerically for each set of initial conditions and parameters of the disease and fungicide applications. Optimization algorithms were investigated and a computer program was developed for optimization of these solutions. 14 typical cases of the disease were simulated and optimized (...) in order to determine optimal fungicide treatments. The optimized strategy for fungicide application differs considerably from the commonly used method and seems to be an important new principle in plant protection. The approach developed in this study may be useful for a wide spectrum of purposes in the simulation of leaf diseases. It may also help the biologist to decrease or pinpoint experimental work and analyze its results and is perspective for plant disease control. (shrink)

(By '�sthetic transactions' I mean to refer to the artist's creation of a work of art and the audience's appreciation of it). For Kant a schema was a rule or principle that enables the under- standing to apply its categories. I would like to begin by welcoming all of you and by saying how nice it is to be President of the AAP NZ DIV or (the altervative Title) and to be addressing you tonight in that capacity. As I began writing this it occurred to me that every former Secretary of this Association must have asked themselves at some time just how meaningful this automatic honour of becoming President the following year actually is. Certainly it is an advantage to (...) be able to deliver your paper first, and to command a decent audience, but I feel that occupying the office of President could be made into something rather special if the following practice, which I intend to inaugurate tonight, were to become an established custom. The fundamental issue dividing Pro- and Anti-abortionists is the question of whether or not the foetus/unborn child is to be regarded as a human being, a person with a right to life. An answer to this question which would satisfy both disputants must be developed in a consistent way from beliefs that are shared between them. I outline these shared beliefs (viz., attitudes towards potential life, and, how and when the value of life is realised by an individual) and argue (...) that the quickening of the foetus is the point at which the adoption of a moral attitude towards it is consistent with both the Pro- and the Antiabortionist standpoint. Published in German during the last 15 years, the 13 essays in this volume provide readers with valuable knowledge of the much discussed theme of hermeneutics today. Gadamer was an early student of Martin Heidegger and has been a lifelong friend and interpreter. These essays are an outgrowth of Gadamer's Truth and Method. They can be understood, however, independently of it. Gadamer's standpoint is a blend of Hegel's and Heidegger's, with his own independent development in part. Personal values have long been associated with individual decision behavior. The role played by personal values in decision making within an organization is less clear. Past research has found that managers tend to respond to ethical dilemmas situationally. This study examines the relationship between personal values and the ethical dimension of decision making using Partial Least Squares (PLS) analysis. The study examines personal values as they relate to five types of ethical dilemmas. We found a significant positive contribution of altruistic (...) values to ethical decision making and a significant negative contribution of self-enhancement values to ethical decision making.
